Making Court of Protection Applications

The forms and procedures for making applications in the Court of Protection can be extremely daunting.

The Court of Protection is a specialist Court which deals with matters relating to individuals who lack the capacity to make decisions.

The Court of Protection can make the necessary decisions and/or appoint deputies to make such decisions. The court will always act in the best interests of those who lack capacity.

The Mental Capacity Act 2005 seeks to define how decisions can be made on behalf of those who lack mental capacity due to reasons such as dementia, stroke, disability, mental health or head injury.
